Officer Brent Aguilar of Clovis Police Department in New Mexico pulled over a motorist who knew his rights and refused to give his ID. New Mexico is a stop and identify state, however as a passenger, the motorist was not legally required to identify under the stop and identify statues as per the fourth amendment.
The statues are legal under Hiibel v. the Sixth district of Nevada which very explicitly states that in order to be legally required to identify, the Terry standard must be met. A seizure under Brendlin v. California does not meet the requirements set by Hiibel.
Nevertheless, because he’s a cop (ie because he can), super judicial Officer Brent Aguilar decided to make this unlawful stop a problem for the motorist, and placed him under arrest for “concealing ID.”
He put the motorist in handcuffs and despite being completely compliant, body slammed him face first to the ground, breaking his cheekbone.
This wasn’t a mistake or bad judgement. The officer was not in “fear for his own life“. This was a flat out physical attack on a handcuffed person who had done nothing.
Meanwhile, the second officer, to whom the Social Justice Warriors (aka useful idiot sheeple) would refer to as the “good cop” just stood there and watched. It should have been his immediate duty to arrest the assailant for assault, but he didn’t. When alleged good cops don’t take down bad cops, they themselves are bad cops even if they don’t do evil acts themselves.
Notice how the aggressor waits until he thinks he is out of range of the camera before he bodyslams the handcuffed victim. Like a fucking psychopath that stalks his victims, bidding his time before he strikes so he can savor the attack thoroughly.
